SMS Consent Proof

Overview

CleanSky Energy obtains prior express consent from customers before sending SMS messages. Consent is collected during the enrollment process and applies to two distinct messaging categories:

  • Informational SMS (Account Notifications) — required for account servicing
  • Marketing SMS — optional and requires separate, explicit opt-in

Customers are not required to consent to marketing SMS as a condition of purchase.

1. Web Enrollment Consent Flow (Primary Opt-In Method)

Customers provide consent while completing enrollment at:
https://cleanskyenergy.com/

The enrollment process is completed on a single page where all SMS disclosures are presented clearly before the customer submits their information.

Example of SMS Consent Collection During Enrollment

The screenshot above is a representative example of the enrollment flow where SMS consent is collected prior to submission.

How Consent is Captured

During enrollment, customers enter their mobile phone number and review the consent language displayed above the submission button.

At the time of consent, customers are informed that message frequency varies based on account activity and/or marketing campaigns.

2. Informational SMS Consent (Account Notifications) Description

Informational SMS messages are sent to customers regarding their energy service and account.

How Marketing Consent Works

Marketing SMS requires a separate checkbox that is unchecked by default and must be actively selected by the customer to opt in.

Example Representation of Checkbox (for clarity)

☐ By checking this box, you consent to receive recurring automated marketing calls and SMS/text messages from CleanSky Energy, its affiliates, and its service providers about pricing, plans, and offers at the phone number provided, including via autodialer or other automated technology and/or prerecorded/artificial voice. Message frequency varies. Message & data rates may apply.

For texts: reply STOP to cancel, HELP for help. To opt out of marketing calls, call (888) 355-6205 or email customerservice@cleanskyenergy.com. Consent is not a condition of purchase.

Consent is recorded only after the customer affirmatively selects the checkbox and proceeds with enrollment.

If the customer selects the checkbox, they agree to receive recurring promotional messages from CleanSky Energy.

4. Separation of Consent Types

CleanSky Energy maintains a clear separation between SMS message categories:

Consent Type

Required for Enrollment

Method of Consent

Informational SMS

Yes

Customer provides mobile number and proceeds with enrollment after reviewing SMS disclosures on screen

Marketing SMS

No

Separate, unchecked checkbox requiring affirmative selection

Customers may enroll in service without consenting to marketing SMS.

5. Additional Consent Methods (Agent-Assisted Enrollment)

Customers enrolling through a sales agent are presented with the same disclosures verbally, including:

  • Message purpose
  • Frequency
  • Message and data rates
  • STOP/HELP instructions
  • Reference to Terms and Privacy Policy

Consent is captured through explicit verbal agreement.

Third-Party Verification (TPV)

For applicable enrollments, customers provide affirmative agreement to informational SMS during recorded third-party verification.

Marketing SMS consent is not collected via TPV.

6. Opt-In Confirmation Message

Upon successful enrollment and consent, customers may receive a confirmation message such as:  CleanSky Energy: You are subscribed to account notifications. Message and data rates may apply. Reply HELP for help, STOP to cancel.

7. Opt-Out and Help Handling

Customers can manage SMS preferences at any time:

  • Reply STOP to opt out of messages
  • Reply HELP for assistance
  • Call (888) 355-6205 for support

Opt-out requests are processed immediately and prevent further messaging.
