SMS Privacy & Messaging Policy

Overview

CleanSky Energy uses SMS (text) messaging to communicate account information, billing alerts, outage/service updates, and marketing offers (where separately authorized). This policy explains how we collect, use, share, retain, and secure mobile phone numbers and SMS consent information.

 

Scope

This policy applies to any mobile phone number you provide to CleanSky Energy (including through our authorized service providers) to receive SMS messages, whether you opt in on our public website, through an agent or IVR, on a paper/tablet form (including door-to-door enrollment), or by texting a keyword (if offered).

 

Consent and message types

By opting in, you expressly consent to receive recurring SMS text messages from CleanSky Energy at the number provided. Messages may be sent using automated technology (including an autodialer) and may include non-automated messages. Message frequency varies. Message and data rates may apply. Consent is not a condition of purchase.

Depending on what you agreed to at opt-in, messages may include:

  • Account-related notifications (such as enrollment confirmations, billing alerts, and service/outage updates); and/or
  • Marketing offers/promotions (such as price/offers), if you separately and expressly opt in to marketing SMS.

 

Opt-in methods (examples)

We may collect SMS opt-in through one or more of the methods below, as presented at the time you provide consent:

  • Website signup form (public): users enter a mobile number and opt in via an unchecked checkbox (or equivalent affirmative action) that includes required disclosures and links to the SMS Terms & Conditions and this policy.
  • Agent/IVR enrollment (internal and authorized vendors): agents use an approved consent script and record the customer’s affirmative response.
  • Door-to-door / paper or tablet form: signed forms (or electronic capture) contain the required disclosures and are stored in the customer record.
  • Keyword opt-in (if offered): texting a published keyword to a published number enrolls the number and triggers an automated confirmation.

 

Required disclosures presented at opt-in include

The purpose of messages, message frequency notice (“Message frequency varies”), “message and data rates may apply,” STOP/HELP instructions, consent not required as a condition of purchase, and links to the SMS Terms & Conditions and this policy.

Help and opt-out

To stop receiving SMS messages, reply STOP to any message. Opt-out is processed immediately upon receipt. After STOP, we will send one confirmation message and will not send further SMS messages unless you re-subscribe.

Opt out by email: you may also request to unsubscribe by emailing customerservice@cleanskyenergy.com. Email requests are processed as soon as reasonably possible; for the fastest opt-out, reply STOP.

 

Confirmation and automated messages (examples)

After opt-in we may send a confirmation message such as:

“CleanSky Energy: You’re enrolled to receive SMS. Msg freq varies. Msg & data rates may apply. Reply HELP for help, STOP to cancel.”

 

Service providers; no sale/sharing of opt-in data

We use third-party service providers (for example, Twilio) to send SMS messages and process opt-in/opt-out requests on our behalf. These providers may process your phone number and message metadata solely to provide services to CleanSky Energy.

No mobile information (including text messaging originator opt-in data and consent) will be shared with or sold to third parties or affiliates for their marketing or promotional purposes.

 

Data collected and retention

We may store the following for SMS compliance and support: phone number, opt-in timestamp (UTC), opt-in source (website/agent/door-to-door/paper/keyword), the consent language shown, page URL or enrollment location, agent/vendor identifier (if applicable), call reference/recording identifier (if applicable), confirmation message status, and opt-out/help records and timestamps.

We retain SMS consent records for 24 months unless a longer retention is required by law or necessary for dispute resolution. We will honor deletion requests subject to legal retention obligations.

 

Security

We restrict access to phone numbers and consent records to authorized personnel and service providers and use reasonable administrative, technical, and physical safeguards to protect these records.

 

Age and eligibility

Participants must be at least 18 years old.

 

Changes to this policy

We may update this SMS Privacy & Messaging Policy from time to time. Material changes will be posted with an updated effective date.
